Farhang Foudation Short Film Festival 2010 - Terms of Use
1. Terms of use Agreement
This Terms of Use Agreement ("Agreement") sets forth the legally binding terms for your use of the Services of Farhang Foundation Short Film Festival, which is run by SoCiArts Productions LLC By agreeing to the hereafter stated Terms and Conditions, you agree to be bound by this Agreement. You (“Filmmaker” “Owner” “Sender” “Film Producer”) are only authorized to use the Services if you agree to abide by all applicable laws and to this Agreement. Please read this Agreement carefully and print it for your records. If you wish to submit your film and exhibit it as part of Farhang Foundation Short Film Festival, make use of the Services, you must read this Agreement and indicate your acceptance by checking the box on the submission form.
2. Festival Mission
Farhang Foundation Short Film Festival Film Festival caters to the art of short filmmaking. Our goal is to run an enterprise that helps to focus attention on works of quality in order to contribute to the progress of short filmmaking. Farhang Foundation Short Film Festival offers and attempts to be the best platform for filmmakers to get their work seen, constantly improve the ways the movies are screened and reach as many audiences possible.
3. Festival Information
At Farhang Foundation Short Film Festival we ask all filmmakers to make an under nine minutes Music Video about the concept of “Iranian Heritage”, and the first prize winner will be granted $10,000USD, second prize winner will be granted $5,000USD, and the third prize winner will be granted $3,000 and will be invited to the annual gala event of Farhang Foundation, celebrating Noruz, the Persian New Year. Travel and lodging expenses are not included. Besides our annual event where the winner films are screened on the big screen, Farhang Foundation Short Film Festival will show all competing movies on the internet.
4. Dates and Deadlines
Submission deadline for the 2010 competition is February 1st, 2010.
The festival maintains the right to change deadlines at any time. Please check the official websites www.farhangfilmfest.org or www.sociarts.com/farhangfilmfest for updates.
Expenses for the shipping (both import/export) of the screener copy and materials including insurance are the sole responsibility of their Owner or Sender. The festival will not return screener copies; special arrangements may be made by emailing a request to:
submissions@sociarts.com. Note that the festival will not pay for any cost arising from the returns under no circumstances.
5. Selection for the Competition and Notification
The festival team chooses and invites the films and filmmakers to participate in competition at Farhang Foundation Short Film Festival. Each film shown in the festival will receive a Certificate of Participation.
Submissions are eligible if they meet all following requirements:
- Films must be less than nine (9) minutes of length including full credits.
- Movie screeners must be one of the following formats: No region-code DVD (both PAL and
NTSC), MiniDV (both PAL and NTSC), and Quicktime (.mov) burnt on DVD-/+R. If for any reason the screener won’t play and thus can’t be viewed you will be notified and required
to resubmit a sample of your short.
- Movies can also be uploaded on www.farhangfilmfest.org by the filmmaker.
- Films must be available in the original language with English subtitles. “Original language” means the one in which a film is, has been or will be exhibited in its country of origin. All subtitling expenses are to be met by the Film Producer.
6. Notification
Farhang Foundation Short Film Festival will notify the selected films by email. If you wish to inquire about the status of your submission, please email us at submissions@sociarts.com. Your film will be in process of consideration until you receive an email stating that it has been accepted or rejected.
Films that have been selected cannot be withdrawn from the festival program prior, during, and after the screening or event.
Upon notification of acceptance and within ten (10) days, you will need to send us the exhibition master of your film as specified in detail in the acceptance email. Failure to do so may result in the loss of your spot in the offered festival program. Expenses for the shipping (both import/export) of your exhibition master, including insurance are the sole responsibility of their Owner or Sender.
The festival cannot be made liable for any loss or damage.
The screening format at Farhang Foundation Short Film Festival is DVD quality or above with an aspect ratio Of 16:9 or 4:3. For optimal compatibility, make sure to export your movie accordingly.
7. Ownership
The filmmaker must be the sole owner of all right, title and interest in and to the submitted film or have secured all rights in the chain of titles; He or she needs to have the exclusive, unconditional
right and authority to submit their film to Farhang Foundation Short Film Festival, and that no third party is entitled to any payment or other consideration of behalf of this film. The filmmaker also warrants
and represents that whatever intellectual property including music and/or trademarks currently contained in the film and not original to the production has secured permission to use.
Filmmaker agrees that his or her film may be exhibited throughout the universe in public, copied, screened, publicly released, transmitted, displayed, streamed, distributed, or translated the whole or a part of the submitted work, any captured scene, footage or title thereof, or any personal information of the applicant to the extent required for its operation and public relation activities through any an all media. Any use of the work for commercial purpose, such as paid distribution or recording on DVD for sale purposes among others will be separately discussed and agreed upon. Filmmaker agrees that his or her film may be on a DVD compilation to be given to special audience members for free by Farhang Foundation.
8. Limitations
Films containing strong language, explicit sexual, religious or political controversial material will not be accepted.
Under no circumstance can the festival be held responsible of the content of films in competition. The filmmaker holds Farhang Foundation Short Film Festival harmless from any claim arising in connection with this.
9. Screening on the Web
All films in competition will be made available online on the official website. There is no additional cost for this service.
Farhang Foundation Short Film Festival retains the right to discontinue streaming movies on the internet at anytime.
The order in which the movies are listed online are randomly determined.
10. Advertising
Farhang Foundation Short Film Festival has the right to use any form and type of advertising in promoting the festival and display such in connection with the films in competition. The filmmakers may not to be part of decision-making in that matter.
The filmmaker gives the festival unconditional permission to use the trailers and short segments of the films in competition as well as any information submitted on the entry form and press kit for promotional purposes without any limitation in time throughout the universe.
11. Festival Event
The annual event of the Farhang Foundation Short Film Festival will be announced with reasonable notice. Please check the website for updates (www.farhang.org). During this event, the winners (also referred to as “finalists”) will be screened in a countdown line-up along with the announcement and honoring of the winning films.
Limited travel arrangements including flight tickets and lodging in connection with the event are covered by Farhang Foundation.
Farhang Foundation Short Film Festival will not pay for any other expenses.
12. Farhang Foundation Short Awards and Jury
The festival team will appoint a jury of minimum 3 members. Each jury member will vote by secret ballot. Farhang Foundation Short Film Festival team will attend Jury deliberations but are not able to vote.
Decisions are final and won’t be commented on.
The producer(s) of Farhang Foundation Short Film Festival will supply all movies out of the year’s competition to the judges in DVD format. Upon viewing the films, the judges will vote and thus determine the
finalists as well as vote for the order of the countdown and winners of the awards.
The votes are collected in ballots cast during the annual event.
13. Prize
Farhang Foundation Short Film Festival will provide the first prize winner with $10,000.00 USD, second prize $5,000 USD, and third prize $3,000 USD. The updated prizes are listed on the festival website.
The winners must be present at the awards night or send a representative to pick up their prize. In no event shall Farhang Foundation Short Film Festival be responsible to mail or messenger
any of the prizes to filmmakers and pay for postage fees. Special arrangements can be made by coordinating with the festival within a reasonable time frame.
14. Privacy Policy
We respect your privacy and the use and protection of your Personal Information. If you have any questions regarding Farhang Foundation Short Film Festival's privacy practices, you may send your question

15. Dispute
If there is any dispute about or involving the Services of Farhang Foundation Short Film Festival, you agree that the dispute shall be governed by the laws of the State of California without regard to conflict of law provisions and you agree to personal jurisdiction by and venue in the state and federal courts of the State of California, City of Los Angeles. Either Farhang Foundation Short Film Festival or you may
demand that any dispute between the Festival and you arising out of this Agreement must be settled by arbitration utilizing the dispute resolution procedures of the American Arbitration Association (AAA) in Los Angeles, California.
16. Indemnification
You agree to indemnify and hold Farhang Foundation Short Film Festival, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above to be liable to another.
17. Limitation on Liability
In no event shall Farhang Foundation Short Film Festival be liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profit damage arising from your use of the services, even if Farhang Foundation Short Film Festival has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Farhang Foundation Short Film Festival’s liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Farhang Foundation Short Film Festival for the Services.
